Terms of Service

Last updated: 6 September 2026

1. About These Terms

These Terms of Service apply to your use of eloiselanebrighton.com and to all purchases made from Eloise Lane Brighton.

By accessing our website or placing an order, you agree to these terms. Please read them carefully before purchasing.

In these terms, “we”, “us” and “our” refer to Eloise Lane Brighton, operated by:

Legal business name: ecomrubo
Trading name: Eloise Lane Brighton
Registered address: Menno van Coehoornwei 1, 9055MC , Britsum, Friesland, Netherlands
KVK number: 89021649
Email: support@eloiselanebrighton.com
Website: https://www.eloiselanebrighton.com

These terms do not affect any mandatory consumer rights available to you under applicable law.

2. Eligibility

You must be at least 18 years old to place an order. If you are under 18, you may only use this website with the involvement and permission of a parent or legal guardian.

By placing an order, you confirm that the information you provide is accurate, complete and current.

3. Products

We make reasonable efforts to display our products, colours, sizes and images accurately. However, colours may appear slightly different depending on your screen, device settings or lighting.

Measurements and size guides are provided as an indication. Minor variations may occur.

We may change, discontinue or limit the availability of a product at any time. All products are subject to availability.

4. Prices

Product prices are displayed in the currency shown on the website, normally pounds sterling (GBP) for customers in the United Kingdom.

We may change our prices at any time, but changes will not affect orders that we have already accepted.

The total price payable, including applicable delivery charges, will be shown during checkout before you complete your purchase.

If additional import taxes, duties or customs charges could apply to your order, these will be handled as stated during checkout or in our Shipping Policy. We will not intentionally hide mandatory charges from you.

5. Orders and Contract Formation

After placing an order, you will normally receive an automatic order confirmation. This confirms that we have received your order but does not necessarily mean that it has been accepted.

A binding sales contract is formed when we confirm acceptance of your order or dispatch the goods, whichever occurs first.

We may refuse or cancel an order for legitimate reasons, including:

  • A product being unavailable

  • An incorrect price or product description

  • Suspected fraud or unauthorised payment

  • Incorrect or incomplete customer information

  • Delivery restrictions

  • A violation of these terms

If we cancel an order after payment has been taken, we will refund the amount paid to the original payment method.

6. Payment

You must pay for your order using one of the payment methods available during checkout.

You confirm that you are authorised to use the selected payment method. Payments may be processed by third-party payment providers, and their additional terms may apply.

We are not responsible for delays caused by your bank, card issuer or payment provider.

7. Discount Codes and Promotions

Discount codes and promotional offers are subject to their stated conditions.

Unless otherwise stated:

  • Only one discount code may be used per order

  • Discounts cannot be applied retrospectively

  • Discount codes cannot be exchanged for cash

  • Promotions may be changed or withdrawn before an order is placed

  • Discount codes may not apply to every product or collection

We may refuse or cancel the use of a promotion where we reasonably believe it has been misused.

8. Shipping and Delivery

Delivery estimates are provided in our Shipping Policy and during checkout. Unless we expressly agree otherwise, delivery dates are estimates and are not guaranteed.

We are not responsible for delays caused by circumstances outside our reasonable control. If a substantial delay occurs, please contact us so we can investigate and explain the available options.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to you where legally permitted.

Risk of loss or damage passes to you when you, or a person nominated by you, physically receives the goods.

Please read our Shipping Policy for full information about processing, tracking and delivery.

9. Cancellations, Returns and Refunds

UK consumers purchasing online normally have the right to cancel most orders within 14 days after receiving the goods. After notifying us of cancellation, the goods must normally be returned within a further 14 days.

Eloise Lane Brighton also offers a 30-day return period, subject to the conditions stated in our Return & Refund Policy.

Certain goods may be excluded from cancellation or return rights where permitted by law, including personalised goods and sealed hygiene-sensitive products after the seal has been broken.

Please read our Return & Refund Policy before returning an item.

10. Faulty or Incorrect Products

You have statutory rights when products are faulty, damaged, not as described or unfit for their normal purpose.

Depending on the circumstances and applicable law, you may be entitled to a repair, replacement, price reduction or refund. UK consumers may have a short-term right to reject faulty goods within 30 days.

Contact support@eloiselanebrighton.com with your order number and photographs of the problem. Nothing in these terms limits your statutory rights concerning faulty goods.

11. Product Care and Use

You are responsible for following any care instructions supplied with a product.

We are not responsible for damage caused by:

  • Normal wear and tear

  • Improper washing, storage or maintenance

  • Misuse of the product

  • Failure to follow the supplied care instructions

  • Alterations or repairs performed by someone else

This does not limit your rights where a product was already faulty or not as described when supplied.

12. Website Information

We try to ensure that information on our website is accurate and current. However, occasional spelling errors, technical errors, pricing mistakes or omissions may occur.

Where we identify an obvious error before accepting an order, we may correct it and give you the opportunity to continue with the corrected information or cancel the order.

We may update or remove website content when reasonably necessary.

13. Acceptable Use

You may not use our website:

  • For unlawful or fraudulent purposes

  • To infringe another person’s rights

  • To transmit viruses, malware or harmful code

  • To collect information about other users without permission

  • To interfere with the security or operation of the website

  • To place fraudulent orders or misuse discounts

  • To copy or commercially exploit website content without permission

We may restrict access to the website where we reasonably believe these terms have been violated.

14. Intellectual Property

All website content, including our trading name, logo, text, graphics, product photographs, videos, designs and layout, belongs to us or is used with permission from the relevant rights holder.

You may use the website for personal, non-commercial shopping purposes. You may not copy, reproduce, distribute, modify or commercially exploit our content without prior written permission.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, delivery companies and social media platforms.

We are not responsible for third-party websites that we do not operate. Your use of those websites may be governed by their own terms and privacy policies.

Nothing in this section removes any responsibility we have for the proper performance of our contract with you.

16. Limitation of Liability

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of mandatory consumer rights

  • Any other liability that cannot legally be excluded

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold through this website are intended for personal use. We are not responsible for business losses, loss of profits, loss of revenue or loss of business opportunities resulting from consumer use of our products.

17. Events Outside Our Control

We are not responsible for delays or failure caused by events outside our reasonable control, such as severe weather, transport disruption, strikes, customs delays, natural disasters, government actions, war, pandemics or failures of telecommunications networks.

If such an event materially affects your order, we will contact you where reasonably possible and explain the available options.

18. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy.

By using our website, you acknowledge that information may be processed by service providers required to operate the store, process payments, prevent fraud and deliver orders.

Please read our Privacy Policy for more information.

19. Complaints

If you have a complaint, contact us at support@eloiselanebrighton.com.

Please include your name, order number and a clear description of the issue. We will make reasonable efforts to review and respond to your complaint promptly.

20. Changes to These Terms

We may update these terms to reflect changes to our services, business practices or legal obligations.

The terms displayed at the time your order is accepted will apply to that purchase. Updated terms will not retrospectively change an existing contract unless required by law.

21. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

22. No Waiver

If we delay enforcing any part of these terms, this does not mean that we have waived our right to enforce it later.

23. Governing Law and Jurisdiction

These terms and any contract between you and us are governed by the laws of the Netherlands.

If you are a consumer living in the United Kingdom, you continue to benefit from any mandatory consumer protections provided by the laws applicable in your country of residence.

Nothing in this section removes your right to bring a claim before a court that has jurisdiction under applicable consumer law.
